Aqua Luxe Pools – Terms & Conditions

These Terms & Conditions apply to all pool and spa services provided by Aqua Luxe Pools (“the Company”) within Auckland.

By engaging our services, the client agrees to the following terms.


1. Scope of Services

Aqua Luxe Pools provides professional cleaning, maintenance, and water management services for residential pools and spas.

Services may include, but are not limited to:

  • Vacuuming and brushing
  • Filter backwashing and system checks
  • Water testing and balancing
  • Equipment inspection
  • Spa draining and refill (where applicable)

Services are performed based on the visible condition of the pool/spa at the time of attendance.


2. Payment Terms

  • Invoices are issued after each service unless otherwise agreed in writing.
  • Payment is due within 7 days of the invoice date.
  • The Company reserves the right to suspend or terminate services if payment is not received by the due date.
  • Outstanding balances must be cleared before services recommence.

3. Service Access & Safety

The client must ensure:

  • Safe, unobstructed access to the pool/spa area
  • Pets are secured
  • Electrical equipment is safely installed

Where access is restricted or the service cannot proceed due to safety concerns, a $40 call-out fee (GST included) may apply.


4. Water Level & Circulation Requirements

The client is responsible for maintaining:

  • Adequate water level (skimmer fully submerged for pools)
  • Proper circulation and filtration between visits

The Company is not liable for:

  • Equipment shutdown due to low water
  • Pump damage caused by dry operation
  • Green water resulting from interrupted filtration
  • Airlocks or blocked skimmer baskets

If service cannot proceed due to insufficient water level or equipment not operating, a call-out fee may apply.


5. Equipment & Structural Responsibility

Aqua Luxe Pools is not responsible for:

  • Pre-existing plumbing leaks
  • Underground pipe failures
  • Structural cracks
  • Faulty installations
  • Manufacturer defects

The client remains responsible for maintaining pool and spa equipment in proper working condition.


6. Chemicals & Water Treatment

Standard service pricing excludes chemicals unless stated.

Where required, Aqua Luxe Pools will:

  • Supply and apply appropriate chemicals
  • Charge based on product used and dosage required

Chemical types may include (but are not limited to):

Chlorine, algaecide, flocculant, stabiliser, calcium hardness increaser, salt, spa sanitiser, pH balancers.

Dosage is determined according to water condition and manufacturer guidelines.


7. Green Pool & Corrective Treatments

Pools or spas presenting with:

  • Algae
  • Cloudy water
  • Heavy debris
  • Neglected circulation

May require corrective treatment beyond standard service scope.

Additional charges may apply for:

  • Shock treatments
  • Algaecide dosing
  • Extended filtration time
  • Multiple visits

Where practical, clients will be informed prior to major additional treatments.


8. Spa-Specific Conditions

Spas require:

  • More frequent chemical adjustment
  • Regular draining (as recommended)
  • Stable water level

Foaming, cloudiness, or rapid chemical imbalance may result from:

  • High bather load
  • Body oils or detergents
  • Infrequent circulation

These are not considered service faults.


9. Weather & External Conditions

Services may be rescheduled due to:

  • Severe weather
  • Electrical safety risks
  • Flooding or unsafe site conditions

10. Service Area

Aqua Luxe Pools operates from the North Shore.

A service area fee may apply to Central and West Auckland properties and will be confirmed prior to service.


11. One-Off Services

For one-off services (including spa draining or green pool recovery), payment may be required:

  • Prior to attendance
  • Or upon completion of service

12. Limitation of Liability

Aqua Luxe Pools shall not be held liable for:

  • Pre-existing conditions
  • Hidden plumbing failures
  • Structural damage
  • Equipment damage caused by improper prior operation
  • Water loss due to undetected leaks

Liability is limited to the value of the service provided.


13. Acceptance of Terms

By booking or continuing services with Aqua Luxe Pools, the client acknowledges and accepts these Terms & Conditions.
